A) Appointment Booking and Cancellation Policies
Please read these GTC carefully and confirm your consent before booking an appointment for permanent makeup or pigmentation with us. If you have any questions, we are here to assist you.
§1 Appointment Booking
1.1. Appointments for permanent makeup or pigmentation can be booked in various ways, including by phone, email, SMS, WhatsApp, or through our booking system.
1.2. The availability of appointments may vary depending on demand and capacity.
§2 Cancellation Policies
2.1. Cancellations of appointments must be made in writing and can be done via email, WhatsApp, SMS, or through our booking system.
2.2. Cancellations must be made at least 24 hours before the scheduled appointment to avoid fees.
2.3. For cancellations made less than 24 hours before the scheduled appointment, we reserve the right to charge a cancellation fee of 50 euros.
§3 No-Show Policy
3.1. If the customer fails to appear for the scheduled appointment without prior cancellation, a fee of 50 euros will be charged.
§4 Changes by the Provider
4.1. The provider reserves the right to cancel or reschedule appointments for unforeseen reasons. In such cases, the customer will be notified as early as possible, and an attempt will be made to offer an alternative appointment.
§5 Disclaimer
5.1. The provider assumes no liability for losses or damages resulting from appointment cancellations or changes.
§6 Data Privacy
6.1. All personal data collected in connection with appointment bookings will be treated in accordance with our privacy policy.
§7 Validity and Changes to the GTC
7.1. These GTC apply from the time of appointment booking and may be amended from time to time without prior notice. Customers will be informed of any changes.
B) Gift Certificate Purchases
§1 Scope and Contracting Parties
1.1. These General Terms and Conditions (GTC) apply to the purchase of gift certificates (“Gift Certificates”) through the website https://www.fynefaces.de (hereinafter referred to as the “Website”). The contracting parties are you as the buyer and Fyne Faces, represented by Hanna Dong, Greifenhagener Strasse 15, 10437 Berlin (hereinafter referred to as the “Provider”).
1.2. Gift Certificates are available through the SumUp platform, which serves as the payment service provider for the processing of Gift Certificate purchases. SumUp’s terms and conditions also apply and can be viewed on their website.
§2 Conclusion of Contract
2.1. By purchasing a Gift Certificate on the Website, the buyer makes a binding offer to conclude a contract for the acquisition of the selected Gift Certificate.
2.2. The contract is concluded as soon as the purchase is made and an order confirmation is sent via email by the Provider to the buyer, who will provide the Gift Certificate to the buyer.
§3 Gift Certificate Information and Validity Period
3.1. Gift Certificates are issued in electronic form and contain a voucher code that can be redeemed at the studio.
3.2. Gift Certificates have a validity period of one year from the date of contract conclusion. After this period, unredeemed Gift Certificates expire automatically and cannot be used anymore.
§4 Redemption of Gift Certificates
4.1. Gift Certificates can be used for the purchase of various services or products offered by the Provider, but only by the same person.
4.2. To redeem a Gift Certificate, the customer provides the voucher code both during the appointment booking process and during on-site billing. The value of the voucher is automatically deducted from the total order amount.
4.3. Gift Certificates can be used only once and are not transferable.
§5 Remaining Value and Refunds
5.1. Gift Certificates cannot be cashed out or exchanged for other vouchers.
5.2. If the total amount of an order is less than the value of the redeemed Gift Certificate, the remaining value remains on the voucher code and can be used for future orders.
§6 Loss and Misuse
6.1. The buyer is responsible for the safe handling of their Gift Certificate. The Provider assumes no liability for loss, theft, or unauthorized use of Gift Certificates.
6.2. In case of misuse or fraud, the Provider reserves the right to block the affected Gift Certificate and take further legal actions.
§7 Right of Withdrawal
7.1. Since Gift Certificates are delivered electronically immediately after purchase, there is no right of withdrawal pursuant to § 312g(2) No. 9 of the German Civil Code (BGB).
§8 Applicable Law and Jurisdiction
8.1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
8.2. The place of jurisdiction for all disputes arising from or in connection with these GTC and the Gift Certificates is Berlin, provided that the buyer is a merchant, legal entity under public law, or a special public fund.
